With Vanity Fair canceling their annual soiree, usually the must attend soiree, Elton's bash was poised to be THE party of the Academy Awards this year.

And then Madonna had to go and muck everything up!

John's party drew a crowd of B and C-lister, like J.C. Chasez, Lionel Richie, Simon Cowell, Larry King and Sean Penn, who obviously wasn't at Madge's soiree.

Madonna's big bash, by comparison, was a star studded A-list affair. Seen: Tom Cruise & Katie Holmes, Cameron Diaz, Demi & Ashton, Drew Barrymore, Owen Wilson and Penelope Cruz - just to name a few.

Plus, M's party was thrown together in a matter of days.

"Elton DESPISES Madonna and this has made things way worse," a source tells us.

Rehab does a body good!

Eva Mendes is back for good from her treatment facility in Utah and looking better than ever.

The actress, who checked herself in last month to deal with some issues, went out to dinner with her long-term and low-key boyfriend, director George Gargurevich, at Madeo's in Beverly Hills on Monday night.

The pair exited the restaurant separately. Mendes was in good enough spirits that she even signed some autographs on the way out.

Comedian Jerry Seinfeld has asked the courts to throw out a lawsuit brought against him for making fun of Missy Chase Lepine, the woman suing his wife for plagiarism.

A comedian making fun of someone is one thing. But disparaging her reputation??? That's major shiz.

Refresher, ya'll!

Lepine is the author of The Sneaky Chef: Simple Strategies for Hiding Healthy Foods in Kids' Favorite Meals. It's a book about how to sneak veggies into dishes in a way your kids would never suss out.

Said book came out in April 2007. Mrs. Seinfeld's book, Deceptively Delicious: Simple Secrets to Get Your Kids Eating Good Food also features ways to fake out your kids by putting veggies in their meals. Seinfeld's book was published in October 2007.

Lepine claims that since her book was out first and that there are some EERILY similar recipes that Seinfeld is a total copycat.

Lawyers for the Seinfelds dismissed the plagiarism allegations in the court filing, saying, "The idea of sneaking healthy foods into a child's diet is not original to your (Lepine) author."

So after Lepine filed the plagiarism lawsuit Jerry Seinfeld went on the Letterman and called Lapine a wacko and compared her to the killers of John Lennon and the Rev. Martin Luther King Jr.

Lepine didn't appreciate that and filed a suit accusing him of slander and defamation.

"Jerry Seinfeld made overstatements of opinion for comic effect," the comedian's lawyers said in the filing.

Overstatement? That's the best your high priced lawyer could come up with??????

Back on Broadway



Sarah Jessica Parker is going back to her roots!

Not only is the actress going back to her role as Carrie in Sex & The City, but she is also set to make her return to Broadway.

SJPeePee will take on the role of an Italian flight attendant in the stage production of 60's comedy pic Boeing Boeing, beginning April at NYC's Longacre Theater.

Parker began her career on Broadway as Annie and has had many memorable appearances on the Great White Way, including How to Succeed… with hubby Matthew Broderick.

Update: A rep for the play denies the report currently circulation and says that Sarah Jessica is not involved with Boeing.

Naomi Campbell Hospitalized!!!!



Details are a bit sketchy, but….

Naomi Campbell is currently in a Brazilian hospital.

The supermodel was taken in for a mysterious "infection."

She is being treated by one of the country's top infections specialists, according to hospital officials.

Journalist Johnathan Wheatley told Sky News that Campbell underwent four-and-a-half hours of surgery.

For an infection????

He said she is being treated by an insectologist who said she went to Brazil specially for the treatment.

Maxim magazine issued an apology to their readers. You know, horny straight dudes that don't like the pink background.

The mag fcuked up and they're owning up to it!

A Maxim music critic gave the Black Crowes' new album War Paint a crappy review…despite the reviewer not even listening to the album!!!!

Shady!

That review rightfully peeved the former Mr. Kate Hudson and his band. They posted a statement on their site last week saying the Maxim writer could not have heard the entire album because advance copies weren't even available. The Crowes' manager, Pete Angelus, said the magazine explained that its review was an "educated guess."

WTF? An educated guess????

The mag has since issued the following statement:

"It is Maxim's editorial policy to assign star ratings only to those albums that have been heard in their entirety. Unfortunately, that policy was not followed in the March 2008 issue of our magazine and we apologize to our readers."

We hope Maxim's sister publication, Blender, doesn't do the same thing!

Naomi Campbell is said to be dating a Brazilian businessman. The supermodel has spent a lot of time recently in the South American country.

The supermodel underwent surgery Monday for what turned out to be an ovarian cyst.

During a consultation prior to her surgery, Naomi's doctor found the presence of a cyst and decided to perform surgery to remove the nodule. The doctors believe that the cyst could get inflamed rapidly if it was not removed.

Naomi is happy and conscious, according to friends.

She could be released from the hospital as soon as three days from now.

Apologies are in the air today!

Oscar producer Gil Cates reportedly called the failure to acknowledge Whoopi Goldberg's stint as a two time Oscar host in a montage "an absolute oversight".

"No harm was intended, and I feel very, very badly that she was left out," Cates said Tuesday. "I'm going to call her and tell her that."

Cates went on to more or less defend the montage in question. The montage supposedly was NOT a host montage. It was meant to highlight exciting Academy Award moments. He also pointed out that former host, Steve Martin, wasn't in the montage.

Cates did give Whoopi some props by calling her a "formidable talent."

Ashlee Simpson takes time to promote “Little Miss Obsessive,” the second single off her new album Bittersweet World on Monday in New York City.

The Aussie stud admitted he’s bald for his upcoming villainous role in the new J.J. Abrams-directed Star Trek movie. Bana, 39, will play the role of the evil Nero.

“It’s a really well-written script, great part,” Bana has said. “Couldn’t say no.”

Jennifer Love Hewitt Planning "Very Small" Wedding Ceremony



Jennifer Love Hewitt is already plotting out her upcoming wedding to Scottish actor Ross McCall.

"Our Love Speaks for Itself"



After releasing the raunchy video "I'm F--king Ben Affleck," Jimmy Kimmel can't stop gushing over his new A-list beau.

“Our love speaks for itself,” Kimmel tells Us.

The video — shot last week at L.A.’s Roosevelt hotel and in an L.A. recording studio — became a YouTube sensation after it debuted following the
Oscars early Monday morning.

Kimmel executive producer Jill Leiderman tells Us the idea came from Kimmel and his director and was "completely fueled by revenge" after Kimmel's girlfriend Sarah Silverman released the video "I'm F--king Matt Damon" last month.

"Sarah and Matt's piece aired on a Thursday, and that Friday, Jimmy came into the office and said, 'We have to get to Ben Affleck, like, right away!'" Leiderman tells Us. "So I reached out to his representation, and by Sunday, Ben was locked."

Was Kimmel nervous about smooching Affleck?

"I don't think there was any fear there," Leiderman says. "I think there's nothing but love there."

The clip featured A-listers like Cameron Diaz making obscene gestures and Harrison Ford blowing Affleck and Kimmel a kiss. "Once Jimmy and Ben were ready to come out to the world, they got the support of their famous friends,” Leiderman says.

As for casting Brad Pitt, who plays a deliveryman, Leiderman tells Us, "We needed to include people who would resonate in Matt's life, and Brad seemed like the perfect accomplice."

Rebecca Romijn tells Us she was more than happy to sign on.

“It was so exciting to help celebrate their love for one another,” Romijn tells Us. "They make a beautiful couple.”

Mischa Barton Charged with DUI, Pot Possession



Mischa Barton has been charged with driving under the influence and possession of marijuana, stemming from her arrest in December, police announced Tuesday.

The former star of The O.C. was also charged with driving without a valid license. Her arraignment on the misdemeanor charges is set for Thursday in Beverly Hills Superior Court.

Barton, 22, was arrested for investigation of DUI in West Hollywood on Dec. 27 after her vehicle was seen straddling two lanes of traffic and she failed to signal when making a turn, police have said.

Judge Rejects Civil Rights Challenge in Britney Case



A federal judge on Tuesday rejected a civil rights challenge in Britney Spears's conservatorship case, allowing the pop star's father to maintain his temporary control of her $100 million estate.

U.S. District Judge Philip Gutierrez returned the case to state probate court and sent a rebuke to the lawyer who launched the challenge, Jon Eardley, who had claimed to represent Spears.

"Mr. Eardley fails to explain why he can bring this claim for her in the first instance. He cannot," Gutierrez said in his three-page ruling. "Mr. Eardley had no authority to remove the case from state court. He is neither a party nor a defendant. While he claims to be Ms. Spears's attorney, the probate court ... found that she was incapable of retaining her own counsel."

Ruling a Victory for Britney's Father
The ruling was a victory for Spears's father, Jamie, who was named as a temporary co-conservator of her estate by the California probate court after Spears was placed under an involuntary, emergency hold at the UCLA Medical Center's psychiatric ward late last month.

As temporary co-conservator, Jamie has great influence over the pop star's fortune as well as her day-to-day activities.

In a highly publicized move, Eardley, a lawyer with practices in Washington, D.C., New York and Whittier, Calif., filed a complaint in U.S. District Court on behalf of Spears. He lashed out against the conservatorship as a "violation of [Spears's] civil rights," and requested the case be moved from California state court to a federal court.

Jamie Spears and the other temporary co-conservator, attorney Andrew Wallet, had called Eardley's move "a brazen – but vain – attempt to strip a probate court of jurisdiction ... by an attorney without a client."

Britney Goes Jeans Shopping
While the federal judge ruled in Jamie Spears's favor, Britney ventured out for an afternoon shopping trip. Spears, accompanied by her assistant and a family friend, arrived at the Levi's Store in Beverly Hills in a chauffeur-driven black Escalade ESV.

"Britney walked in to the store in jeans with a green top and a huge smile," eyewitness Brenda Gold tells PEOPLE.

Pamela Anderson Now Seeking Annulment



Pamela Anderson is now seeking to annul her brief marriage to Rick Salomon rather than getting a standard divorce, according to court papers.

Anderson cited "fraud" as the reason for the annulment. No details were given in the court papers, which were filed last Friday in Los Angeles Superior Court.

After just two months of marriage, Anderson, 40, filed for divorce from Salomon, 39, in December, citing irreconcilable differences.

They were married last October in Las Vegas during a 90-minute break between the magic shows in which Anderson was appearing.

Drew Barrymore Opens Up About Justin Long



Keeping in constant character for the role of Jackie Kennedy's eccentric cousin Edie Beale in HBO's upcoming Grey Gardens, Drew Barrymore refers to her real-life boyfriend Justin Long not by his name, but by the Edie-like label of "gentleman caller."

Tracking the relationship between the actress-producer and the "Mac" in the Apple computer commercials, the March issue of Vogue, reports that the two knew each other for seven years before becoming serious.

Asked for his immediate reaction to what he thinks of when it comes to Barrymore, Long – who helped Drew celebrate her 33rd birthday this month – responds, "Beauty and light, and she shines it on everybody who comes into contact with her."

As for her reaction to Long, a perennially smiling Barrymore says, "My cheeks hurt, I'm so happy." Adds Long, 29: "She makes my cheeks hurt, too."

Past Not Up to Speed
It wasn't always so. While Barrymore considers herself secure in terms of dealing with her profession and her friendships, as far up-close-and-personal relationships are concerned, "for some reason, I have not grown up to the speed I am elsewhere," she says.

Having twice walked down the aisle, Barrymore – who, exactly a year ago at this time, insisted she was happy to be single – and first husband, bar owner Jeremy Thomas, split after five weeks, while her marriage to gross-out comedian Tom Green lasted five months before he filed for divorce.

The day after unveiling her baby bump at the Film Independent's Spirit Awards, Angelina Jolie spent Oscar night at home, relaxing.

Jolie, 32, and Brad Pitt, 44, were at home in Los Angeles with the kids and enjoyed the relative peace and quiet, a source tells PEOPLE.

Though neither was at the Oscar ceremony, their absence didn't stop the show's host, Jon Stewart, from including Jolie in a joke about pregnant actresses, saying, "Obviously, Angelina Jolie couldn't be here – it's hard to find 17 babysitters on Oscar night."

The growing Jolie-Pitt family currently includes Maddox, 6, Pax, 4, and Zahara, 3, and Shiloh, 1. A source close to the couple says they are "thrilled to be adding to their brood."

Gumballs Keep Falling on His Head

Adam Sandler separated himself from his beloved Matzo Ball long enough to get to filming Bedtime Stories in LA yesterday. If you couldn't gather from these photos, the movie has a bit of a fantasy element — including a gumball rainstorm it seems — telling the story of a man whose bedtime stories he tells his nephew start to come true. Carmen Electra apparently makes an appearance in this scene, but his real leading lady in the movie is Keri Russell. Considering the soft spot I have for both Sandler and Russell I'm thinking I may have an even bigger one for this movie.

According to Variety, Warner Brothers has announced that the release date for the highly anticipated 'Terminator Salvation: The Future Begins,' will be May 22, 2009.

The movie, starring CHRISTIAN BALE, begins its two-month shoot on May 5 in New Mexico.

Kate Walsh Sends Her Apologies



Kate Walsh promotes her medical drama, Private Practice, after arriving at the Quay Grand Hotel in Sydney, Australia on Wednesday. She’s also reportedly promoting her new movie One Way to Valhalla.

It was recently announced that Kate won’t be performing in “Good Medicine,” a musical benefit at UCLA’s Royce Hall on Friday to benefit crew members who were affected by the strike. Other cast members from Grey’s Anatomy and Private Practice will be there to perform, though! Here’s Kate’s personal (and funny) apology:

I am so bummed not only that we can’t be there for you and our crew, but because I hate to miss what promises to be an unbelievably great evening. Audra McDonald, Sara Ramirez and Loretta Devine (known to you as the chief’s wife, Adele. She played Effie in the very first Broadway Production of Dreamgirls) are singing! Not to mention T.R. Knight, Chandra Wilson, Amy Brenneman and Paul Adelstein, Tim Daly and Chris Lowell… they’re all going to sing! And so are Chief Webber and his real-life wife Gina, also a Broadway veteran. Aside from all the music, there will be appearances by Katherine Heigl, Brooke Smith, Sandra Oh, Justin Chambers, Chyler Leigh, Eric Dane and Taye Diggs. Basically everyone’s gonna be there. Except me. I cannot believe I have to miss this. Crap. Our crews are the people who make all of it possible. I am so excited this evening is happening to raise money for them and so so sad I won’t be there. I hope you forgive us and I hope you have a wonderful time.

The Spice Girls: The Final Show



The Spice Girls wrapped up the final show of their world tour. Here’s their farewell message from their official blog:

Victoria Promotes DvB Without the D



Before taking the stage with the Spice Girls for the final stop on their reunion tour last night, Victoria Beckham headed to Holt Renfrew in Toronto to promote her DvB clothing line. Our friend Fab UK thinks her look is a bit harsh, but she looks polished as usual to us. Sad that we won't see the whole Spice entourage traveling from city to city together anymore, but now we're gearing up for the Beckham family reunion.

David Archuleta Moves Judges On 'American Idol'



The “American Idol” judges found themselves floored on Tuesday night after a stirring performance by 17-year-old David Archuleta.

One of the youngest contestants in the competition, Archuleta put in a moving performance at the conclusion of the second week of “American Idol” competition, with his rendition of John Lennon’s “Imagine.”

“Dog,” judge Randy Jackson began, “that’s one of the best vocals I’ve ever heard on the show. You’re singing with maturity way beyond your years… That was brilliant.”

Paula Abdul went one step further with her praise for the blue-eyed teen.

“That was one of the most moving performances I’ve ever heard,” Abdul said. “You’re destined for superstardom.”

And even Brit Simon Cowell appeared impressed by the young man’s performance.

“[It was] very, very risky to do a John Lennon song, particularly that one, but it worked,” Simon said. “Right now, you’re the one to beat.”

Archuleta’s performance may have received the best comments from the judges, but several other of the men who sang on Tuesday night, were praised.

Chikezie, who last week was berated by Simon for his orange suit, came out on top.

“You looked better, you sounded better,” Simon said of Chikezie’s rendition of Donny Hathaway's “I Believe.”

David Hernandez, from Glendale, Arizona, also received praise after singing “Papa Was a Rolling Stone.”

“That’s the [David] we fell in love with. Dope! Dope! Dope!” Randy enthused.

Not fairing as well with the judges were dreadlocked Jason Castro and Jason Yeager.

Castro sang “I Just Want To Be Your Everything,” much to Simon’s dismay.

“I thought the song was horrible because you were too schmaltzy,” Simon said of Castro’s performance. “It didn’t suit your voice.”

As for Yeager’s take on the Doobie Brothers’ “Long Train Running,” Randy rated it poorly.

“It wasn’t a singer’s kind of song … and it was very pitchy and karaoke. For me, I didn’t get it,” he said.

'Sorry' Madonna, No Jury Duty For You



After staying out late at a post-Oscars party, Madonna performed her civic duty on Monday, turning up for jury duty.

The pop sensation filed into court in Beverly Hills courthouse, wearing a Juicy Couture sweatsuit according to reports.

Madonna spent the day waiting to find out if she would be chosen for a jury.

The singer added some spice to the affair, however, by changing clothes during the court’s lunch break, returning for the afternoon session in black pants and a jacket.

But, it appears no one’s fate will be decided with the help of the singer, as she was not picked for a trial in the end.

She has, however, been picked for this year’s class at the Rock and Roll Hall of Fame, and In Touch reported today that Justin Timberlake will induct her.

Madonna and Justin recently collaborated in London on a new song for her record, reportedly called "4 Minutes To Save The World."

Janet Jackson will appear on the double cover of VIBE Magazine’s April 2008 issue, the magazine’s ‘first-ever’ photo issue.

On growing up in her household: “I remember being a kid and they’d come over … you take so much for granted…. you’re not thinking about the fact that it’s Marvin Gaye over all the time, or Diana [Ross] or Smokey [Robinson].”

On her relationship with super-producer Jermaine Dupri: “Married or not, it’s not important … I feel like it’s it …. It’s been about eight years. He’s just a sweetheart. Truly a good-hearted person.”

On being a responsible child in the entertainment business: “One of the major things was my work ethic, since I was a kid … I never had my mother wake me up … I’d get myself up everyday. It never struck me … that’s a lot of difficulty for a 10-year-old … I don’t know if it’s something in the genes, or from watching my brothers, seeing them working hard.”

Zac Efron practices his lines on the set of his new film Me and Orson Welles in the Gaiety Theatre, Douglas, on the Island of Man.

Zac is looking majorly sleek with his new hairdo, as captured by Isle of Man Today.

The other film Zac was recently filming back in L.A. was 17 Again. Producer Adam Shankman (and Hairspray director) had a few words to say about Zac:

“We have some very funny [dancing] scenes between him and Leslie Mann from Knocked Up, which are off-the-charts funny. But there’s also this big thing with Zac dancing with a lot of cheerleaders that is very, very fun and funny. People are going to be so surprised how seriously great he is in this movie. I’m really proud. This is about a man whose life has not gone the way he wants it to, so he wishes he was 17 again and he gets his wish. And then he’s realizing it’s nothing like he thought it would be. So it’s a reverse Big. It has as many funny scenes in it as it does heartfelt scenes. [Zac] has to carry this whole movie as a comedian. But there are some very emotional scenes as well.”

Amy Winehouse's friends are so worried about her, they are begging she go back to rehab.

The Sun is reporting that Wino's friends are witnessing her slowly returning back to her old ways ever since she left a rehab clinic a few weeks ago.

We've said it before. We'll say it again.

You can't treat a crack and heroin addiction in TWO WEEKS!

Even her incarcerated hubby, Blake Fielder-Civil, has threatened to ban Ames from visiting him in jail because he's convinced she's still on crack cocaine.

You know his motto. If he can't have any, neither can she!

A friend of Winehouse's says, "Amy’s in an awful state again. She’s clearly on drugs. Many of us think full-time residential rehab is the only option but she won’t go back."

Amy has recently been spotted with scratches on her arms and mysterious marks and spots on her knuckles. Wino has a troubling history of self-harming while being high on drugs.

A source also added that Winehouse "was smoking cannabis and drinking heavily as soon as she left rehab. That has now increased. Everyone who’s seen her in the last week or so has been really disturbed by the state she’s in. She’s getting back to her worst. It was hoped her new album and fashion range would keep her focused but it hasn’t worked."

ScarJo is Mystifying!



Yes, Scarlett Joahnsson really is doing an album of little known (but critically beloved) songs by Tom Waits.

The record comes out in May and none other than David Bowie provides background vocals on two tracks.

And he swears that ScarJo is good. More than good, actually.

Bowie says on his official website, "The songs are great, really good Tom Waits stuff, and Scarlett's performances are mystical and twice cool."
